The free app and the Full Version

• The app is free to download and use: the carillon strikes the quarters and, on request, the time as a minute repeater does.
• The Full Version is a one-time purchase, made through the App Store or Google Play, that unlocks the logbook, its summary, gauges and certificate, the gold movement, full night scheduling and the colour themes. There is no subscription and no recurring charge.
• The purchase is a contract concluded through Apple or Google under their terms; they process the payment, deliver the unlock and handle refunds under their own rules. The unlock is tied to the store account that bought it and can be restored on that account's devices.
• The price is a fixed amount set per country in the store; the store shows it before purchase.

Carillon for Institutions

• Carillon for Institutions contains no purchase. It is licensed to an organisation under a written licence agreement between that organisation and Swandex Technology, which sets the number of seats, the term and the price.
• The organisation gives its members an activation code. Each activation uses one seat. A code may be used only by the organisation's members and only within the licensed number of seats.
• Members use the app under these terms; the licence agreement governs the relationship with the organisation.

The logbook is yours

• Everything written in the logbook belongs to the user and stays on the device. Swandex Technology has no access to it and keeps no copy.
• Because the logbook lives on the device only, exporting it is the user's responsibility: the app offers export, daily copies on the device and a restore, and uninstalling the app deletes everything it stores.
• The app is an instrument for attention and habit, not a medical device, a therapy or professional advice. Decisions about health, work or money remain the user's own.

The certificate

• The Full Version can issue a certificate of consistency for the logbook habit, on the user's request only. It attests to how often the logbook was written over 30 days, as counted by the app on the device, and nothing else.
• The name entered for the certificate is shown on it and on its verification page. The user is responsible for entering a name they are entitled to use.
• Swandex Technology may withhold or withdraw a certificate obtained by manipulating the count, and may remove one at the user's request as described in the privacy policy.
• No third party is obliged to recognise the certificate.

Acceptable use

• The app, the activation service, the certificate service and swandex.com may be used only lawfully and as intended.
• Activation codes, certificate records and the services behind them may not be shared outside the licence, forged, probed or overloaded.
• The app's sounds, graphics, texts and code are protected by copyright and may not be copied or reused outside the app, except as the law allows. The brand SWANDEX and the Carillon names may not be used without written permission.

Availability and changes

• The app depends on the device and its system: notifications, sound, Focus modes and battery settings are controlled by the user and by Apple or Google, and may silence or delay the chimes.
• Features may be added, changed or removed with updates. The Full Version keeps what it unlocked at the time of purchase or its equivalent.
• The activation and certificate services may be interrupted for maintenance and may be discontinued with reasonable notice; the app keeps working without them.

Warranty and liability

• The app is provided as it is. Swandex Technology undertakes to correct reported defects within a reasonable time but does not promise that the app is free of errors or fits a particular purpose.
• To the extent the law allows, Swandex Technology is not liable for indirect damage, lost data, lost profit or consequences of a chime that did not sound or sounded late. Liability for intent and gross negligence, and for personal injury, is not limited.
• Mandatory consumer rights, including those of consumers in the European Economic Area and the United Kingdom, are not affected by these terms.

Law and venue

These terms are governed by Swiss law. Venue is Conthey, Valais, Switzerland, unless mandatory law gives a consumer another court.

Changes

If these terms change, the date at the top of this page changes with them. The terms in force are the ones published here at the time of use.

Die kostenlose App und die Vollversion

• Die App kann kostenlos geladen und genutzt werden: Das Carillon schlägt die Viertelstunden und auf Wunsch die Uhrzeit, wie es eine Minutenrepetition tut.
• Die Vollversion ist ein Einmalkauf über den App Store oder Google Play, der das Logbuch mit Zusammenfassung, Anzeigen und Zertifikat, das goldene Uhrwerk, die vollständige Nachtplanung und die Farbschemata freischaltet. Es gibt kein Abonnement und keine wiederkehrende Zahlung.
• Der Kauf ist ein Vertrag, der über Apple oder Google zu deren Bedingungen geschlossen wird; sie wickeln die Zahlung ab, liefern die Freischaltung und bearbeiten Rückerstattungen nach ihren eigenen Regeln. Die Freischaltung ist an das Store-Konto gebunden, das sie gekauft hat, und kann auf dessen Geräten wiederhergestellt werden.
• Der Preis ist ein fester, pro Land im Store festgelegter Betrag; der Store zeigt ihn vor dem Kauf an.

Carillon für Institutionen

• Carillon für Institutionen enthält keinen Kauf. Es wird einer Organisation unter einem schriftlichen Lizenzvertrag zwischen dieser Organisation und Swandex Technology überlassen, der die Zahl der Plätze, die Laufzeit und den Preis festlegt.
• Die Organisation gibt ihren Mitgliedern einen Aktivierungscode. Jede Aktivierung belegt einen Platz. Ein Code darf nur von Mitgliedern der Organisation und nur im Rahmen der lizenzierten Plätze verwendet werden.
• Mitglieder nutzen die App zu diesen Bedingungen; das Verhältnis zur Organisation regelt der Lizenzvertrag.

Das Logbuch gehört dir

• Alles, was im Logbuch steht, gehört der nutzenden Person und bleibt auf dem Gerät. Swandex Technology hat keinen Zugriff darauf und behält keine Kopie.
• Weil das Logbuch nur auf dem Gerät liegt, ist der Export Sache der nutzenden Person: Die App bietet Export, tägliche Kopien auf dem Gerät und eine Wiederherstellung; wer die App deinstalliert, löscht alles, was sie speichert.
• Die App ist ein Instrument für Aufmerksamkeit und Gewohnheit, kein Medizinprodukt, keine Therapie und keine fachliche Beratung. Entscheidungen über Gesundheit, Arbeit oder Geld bleiben die eigenen.

Das Zertifikat

• Die Vollversion kann auf Wunsch ein Zertifikat der Beständigkeit für die Logbuch-Gewohnheit ausstellen. Es bescheinigt, wie oft das Logbuch in 30 Tagen geschrieben wurde, so wie die App es auf dem Gerät gezählt hat, und sonst nichts.
• Der für das Zertifikat eingegebene Name erscheint darauf und auf seiner Prüfseite. Die nutzende Person ist dafür verantwortlich, einen Namen einzugeben, den sie führen darf.
• Swandex Technology kann ein durch Manipulation der Zählung erlangtes Zertifikat verweigern oder zurückziehen und entfernt ein Zertifikat auf Wunsch, wie in der Datenschutzerklärung beschrieben.
• Niemand ist verpflichtet, das Zertifikat anzuerkennen.

Zulässige Nutzung

• Die App, der Aktivierungsdienst, der Zertifikatsdienst und swandex.com dürfen nur rechtmäßig und bestimmungsgemäß genutzt werden.
• Aktivierungscodes, Zertifikatsdatensätze und die dahinterliegenden Dienste dürfen nicht außerhalb der Lizenz weitergegeben, gefälscht, ausgeforscht oder überlastet werden.
• Klänge, Grafiken, Texte und Code der App sind urheberrechtlich geschützt und dürfen außerhalb der App nicht kopiert oder weiterverwendet werden, soweit das Gesetz nichts anderes erlaubt. Die Marke SWANDEX und die Namen Carillon dürfen ohne schriftliche Erlaubnis nicht verwendet werden.

Verfügbarkeit und Änderungen

• Die App hängt vom Gerät und seinem System ab: Mitteilungen, Ton, Fokus-Modi und Batterieeinstellungen werden von der nutzenden Person und von Apple oder Google gesteuert und können die Schläge stummschalten oder verzögern.
• Funktionen können mit Updates hinzukommen, sich ändern oder entfallen. Die Vollversion behält, was sie zum Zeitpunkt des Kaufs freigeschaltet hat, oder Gleichwertiges.
• Der Aktivierungs- und der Zertifikatsdienst können für Wartung unterbrochen und mit angemessener Ankündigung eingestellt werden; die App funktioniert ohne sie weiter.

Gewährleistung und Haftung

• Die App wird so bereitgestellt, wie sie ist. Swandex Technology verpflichtet sich, gemeldete Mängel in angemessener Frist zu beheben, verspricht aber nicht, dass die App fehlerfrei ist oder sich für einen bestimmten Zweck eignet.
• Soweit das Gesetz es erlaubt, haftet Swandex Technology nicht für mittelbare Schäden, Datenverlust, entgangenen Gewinn oder Folgen eines Schlags, der nicht oder zu spät ertönte. Die Haftung für Absicht und grobe Fahrlässigkeit sowie für Personenschäden ist nicht beschränkt.
• Zwingende Verbraucherrechte, auch die von Verbraucherinnen und Verbrauchern im Europäischen Wirtschaftsraum und im Vereinigten Königreich, bleiben von diesen Bedingungen unberührt.

Recht und Gerichtsstand

Diese Bedingungen unterstehen Schweizer Recht. Gerichtsstand ist Conthey, Wallis, Schweiz, soweit zwingendes Recht Verbrauchern kein anderes Gericht zuweist.

Änderungen

Ändern sich diese Bedingungen, ändert sich das Datum oben auf dieser Seite mit. Es gelten die hier zum Zeitpunkt der Nutzung veröffentlichten Bedingungen.

L'application gratuite et la version complète

• L'application se télécharge et s'utilise gratuitement : le carillon sonne les quarts et, à la demande, l'heure, comme le fait une répétition minutes.
• La version complète est un achat unique, effectué par l'App Store ou Google Play, qui débloque le journal de bord avec son résumé, ses jauges et son certificat, le mouvement doré, la programmation complète de la nuit et les thèmes de couleurs. Il n'y a ni abonnement ni paiement récurrent.
• L'achat est un contrat conclu par l'intermédiaire d'Apple ou de Google, à leurs conditions ; ils traitent le paiement, livrent le déblocage et gèrent les remboursements selon leurs propres règles. Le déblocage est lié au compte de la boutique qui l'a acheté et peut être restauré sur les appareils de ce compte.
• Le prix est un montant fixe, défini par pays dans la boutique ; la boutique l'affiche avant l'achat.

Carillon pour les institutions

• Carillon pour les institutions ne contient aucun achat. Elle est concédée à une organisation par un contrat de licence écrit entre cette organisation et Swandex Technology, qui fixe le nombre de postes, la durée et le prix.
• L'organisation remet un code d'activation à ses membres. Chaque activation occupe un poste. Un code ne peut être utilisé que par les membres de l'organisation et dans la limite des postes sous licence.
• Les membres utilisent l'application selon ces conditions ; le contrat de licence régit la relation avec l'organisation.

Le journal de bord vous appartient

• Tout ce qui est écrit dans le journal appartient à l'utilisateur et reste sur l'appareil. Swandex Technology n'y a pas accès et n'en garde aucune copie.
• Comme le journal ne vit que sur l'appareil, son exportation relève de l'utilisateur : l'application propose l'exportation, des copies quotidiennes sur l'appareil et une restauration ; désinstaller l'application supprime tout ce qu'elle conserve.
• L'application est un instrument d'attention et d'habitude, pas un dispositif médical, une thérapie ou un conseil professionnel. Les décisions de santé, de travail ou d'argent restent celles de l'utilisateur.

Le certificat

• La version complète peut délivrer, à la seule demande de l'utilisateur, un certificat de constance pour l'habitude du journal. Il atteste de la fréquence à laquelle le journal a été écrit sur 30 jours, telle que l'application l'a comptée sur l'appareil, et rien d'autre.
• Le nom saisi pour le certificat y figure ainsi que sur sa page de vérification. L'utilisateur est responsable de saisir un nom qu'il a le droit de porter.

Usage acceptable

Garantie et responsabilité

• L'acquisto è un contratto concluso tramite Apple o Google alle loro condizioni; sono loro a trattare il pagamento, consegnare lo sblocco e gestire i rimborsi secondo le proprie regole. Lo sblocco è legato all'account dello store che lo ha acquistato e può essere ripristinato sui dispositivi di quell'account.
• Il prezzo è un importo fisso, stabilito per paese nello store; lo store lo mostra prima dell'acquisto.

Carillon per le istituzioni

• Carillon per le istituzioni non contiene acquisti. È concessa a un'organizzazione con un contratto di licenza scritto tra quell'organizzazione e Swandex Technology, che fissa il numero di postazioni, la durata e il prezzo.
• L'organizzazione consegna ai propri membri un codice di attivazione. Ogni attivazione occupa una postazione. Un codice può essere usato solo dai membri dell'organizzazione e solo entro il numero di postazioni in licenza.
• I membri usano l'app secondo queste condizioni; il contratto di licenza regola il rapporto con l'organizzazione.

Il registro è tuo

• Tutto ciò che è scritto nel registro appartiene all'utente e resta sul dispositivo. Swandex Technology non vi ha accesso e non ne conserva copia.
• Poiché il registro vive solo sul dispositivo, esportarlo spetta all'utente: l'app offre l'esportazione, copie giornaliere sul dispositivo e un ripristino; disinstallare l'app cancella tutto ciò che conserva.
• L'app è uno strumento per l'attenzione e l'abitudine, non un dispositivo medico, una terapia o una consulenza professionale. Le decisioni su salute, lavoro o denaro restano dell'utente.

Il certificato

• La versione completa può rilasciare, solo su richiesta dell'utente, un certificato di costanza per l'abitudine del registro. Attesta con quale frequenza il registro è stato scritto in 30 giorni, così come l'app l'ha contata sul dispositivo, e nient'altro.
• Il nome inserito per il certificato compare su di esso e sulla sua pagina di verifica. L'utente è responsabile di inserire un nome che ha il diritto di usare.
• Swandex Technology può rifiutare o ritirare un certificato ottenuto manipolando il conteggio, e rimuove un certificato su richiesta dell'utente come descritto nell'informativa sulla privacy.
• Nessun terzo è tenuto a riconoscere il certificato.

Uso consentito

• L'app, il servizio di attivazione, il servizio di certificato e swandex.com possono essere usati solo in modo lecito e conforme alla loro destinazione.
• Codici di attivazione, registrazioni dei certificati e i servizi che li sostengono non possono essere condivisi fuori dalla licenza, falsificati, sondati o sovraccaricati.
• Suoni, grafica, testi e codice dell'app sono protetti dal diritto d'autore e non possono essere copiati o riutilizzati fuori dall'app, salvo quanto consentito dalla legge. Il marchio SWANDEX e i nomi Carillon non possono essere usati senza autorizzazione scritta.

Disponibilità e modifiche

• L'app dipende dal dispositivo e dal suo sistema: notifiche, audio, modalità Full immersion e impostazioni della batteria sono controllati dall'utente e da Apple o Google, e possono silenziare o ritardare i rintocchi.
• Le funzioni possono essere aggiunte, modificate o rimosse con gli aggiornamenti. La versione completa conserva ciò che ha sbloccato al momento dell'acquisto, o il suo equivalente.
• I servizi di attivazione e di certificato possono essere interrotti per manutenzione e cessati con ragionevole preavviso; l'app continua a funzionare senza di essi.

Garanzia e responsabilità

• L'app è fornita così com'è. Swandex Technology si impegna a correggere i difetti segnalati in un tempo ragionevole, ma non promette che l'app sia priva di errori o adatta a uno scopo particolare.
• Nella misura consentita dalla legge, Swandex Technology non risponde di danni indiretti, perdita di dati, mancato guadagno o conseguenze di un rintocco non suonato o suonato in ritardo. La responsabilità per dolo e colpa grave, e per danni alla persona, non è limitata.
